4.19.23 - MINUTE ORDER. In light of the resolution of the discovery dispute, the status conference scheduled for April 20, 2023, is VACATED.

Documents previous to this date all led up to the court ordered mediation process, which ultimately failed.

While the companies (separate from Chris) had initially reached a bifurcated settlement agreement, when the companies received the final agreement from the SEC, the terms were not agreeable. The SEC wanted Chris and the companies to sign a boilerplate agreement that was not acceptable. Among other things, Chris and the companies insisted that any disgorgement ordered by the Court be mandatory, not optional, and remanded to the Fair Fund for disbursement to investors. The mediation process was under NDA and so the details were not released.

All things considered, Chris and the companies felt it would be best to argue the case to its fullest.
